The EEA Regulations 2006 also provide provisions for other family members to join EEA Nationals in the UK.
If you are the parent, brother, sister, cousin or another family member of an EEA National, you can apply under this category. You must evidence your relationship with the EEA National, evidence that you are dependent upon their support and that they were supporting you before your entered the UK and also evidence that they are exercising their Treaty Rights in the UK.
We got above the result we were expecting – so I would recommend! My wife had missed the visa application deadline for ILR due to being a busy mum and missing the sneaky government rule change on English tests and 30 day grace period. We were advised by one lawyer to go down the Human rights route – given the current government climate on immigration. Ravi advised to try ILR anyway. He put forward an expert application based on the Mum and Child needing to be together. It was a long wait – as no doubt it was put in the ‘difficult box’ by the UKBA but all good in the end. No need even for an appeal, it was cleared straightaway. We are delighted and this has saved us money in the long run as we now do not need to apply for any further visas ever!
